The offer and sale of products on our website www.shoesofitaly.com (and on the linked website www.shoesofitaly.it which is automatically associated in this document with the main website www.shoesofitaly.com) are governed by these Conditions of Sale. 

The products purchased on www.shoesofitaly.com are sold directly by SOI di Achilli Riccardo (“The Seller”), with registered office in Italy, Via del Casone 10/A, Civitanova Marche, MC, R.E.A. Macerata 301210, C.F. CHLRCR83P05E388B and VAT number 02139620435.

These general conditions of sale are an integral and essential part of the sales contract, for this reason they must be examined “online” by the customer before completing the purchase procedure.
The forwarding of the order confirmation implies full knowledge and full acceptance of them.

The seller assumes no responsibility for disservices attributable to force majeure or unforeseeable circumstances, even if dependent on malfunctions and disservices of the internet network, in the event that he is unable to execute the order in full or within the times set out in the contract.

COMMERCIAL POLICY

The Seller offers products for sale on www.shoesofitaly.com, the products and the conduct of its e-commerce activity are available exclusively to its end users, or “Consumers” of age + 18 years.

For “consumer” we mean any adult person who acts on www.shoesofitaly.com for purposes not related to his own commercial, entrepreneurial or professional activity. 

In consideration of its commercial policy, the Seller reserves the right not to accept orders from subjects other than “Consumers” and any orders that do not comply with its commercial policy.

These Conditions of Sale exclusively regulate the offer, forwarding and acceptance of purchase orders for products on www.shoesofitaly.com, between users of www.shoesofitaly.com and the Seller.

The customer, by electronically sending the confirmation of his purchase order, unconditionally accepts and undertakes to observe in his relations with the Seller, the general terms and conditions, including the payment terms listed below, declaring that he has read and accepted all the information provided to him.

The General Conditions of Sale do not regulate the supply of services or the sale of products by parties other than the Seller who are on www.shoesofitaly.com through links, brand names of suppliers and manufacturers, banners or other hypertext links if any.

HOW TO PURCHASE

To complete the purchase of one or more products on www.shoesofitaly.com, you must fill in the order form in electronic format and send it to the Seller, by computer or other device, following the relative instructions.

The order form contains a link to these Conditions of Sale and the information on the right of withdrawal, and a summary of the information on the characteristics of each product ordered and its price.

All sales prices of the products displayed and indicated on the website www.shoesofitaly.com, which constitute an offer to the public pursuant to art. 1336 cc, are inclusive of VAT (excluding countries for which exemption is envisaged). As for the sale, therefore inclusive of all applicable taxes or shipping costs including and excluding customs duties (to be paid upon delivery when due).

The contract is concluded when the Seller receives your order form electronically and after verifying the accuracy of the data relating to your order.

Before proceeding with the purchase of the product by sending the order form, you will be asked to carefully read the General Terms & Conditions of Sale and the Information on the Right of Withdrawal.

The order form will be filed in our database for the period of time necessary to process the order and as required by law.

The languages ​​available to conclude the contract with the Seller are Italian and English.

By submitting the order form, the consumer unconditionally accepts and undertakes to accept these Conditions of Sale in relations with the Seller. If you do not agree with some of the terms of the General Conditions of Sale, please do not submit the order form for the purchase of products on www.shoesofitaly.com.

With the transmission of the order confirmation form, the consumer agrees to accept the General Conditions of Sale and the additional information contained on www.shoesofitaly.com, also through links, including the Information on the Right of Withdrawal and the legislation on the Privacy Policy.

With the contract, the Seller will send them, by e-mail, a receipt of the purchase order, containing the information already contained in the order form (please refer to the General Conditions of Sale and Right of Withdrawal, the relative information, essential characteristics of the product and detailed indication of price, payment methods, right of withdrawal and delivery costs).

WARRANTIES AND INDICATION OF PRODUCT PRICES

On www.shoesofitaly only made in Italy branded items are offered by the Seller.

The Seller does not sell used, irregular or inferior quality products to the corresponding market standards.

The essential characteristics of the products are presented on www.shoesofitaly.com within each product sheet. The images and colors of the products offered for sale on www.shoesofitaly.com may not correspond to the real ones due to the Internet browser and monitor used.

Product prices may be subject to change. The consumer is invited to check the final sale price before submitting the related order form.

Given the high quality that distinguishes the products selected in www.shoesofitaly.com, we invite consumers who have purchased footwear to try them on a soft surface so as not to scratch and / or otherwise deteriorate the sole of the shoe. Any returns of items with imperfections or with non-perfectly intact soles will not be accepted.

PAYMENTS AND CURRENCIES

The currency you make purchases in is determined by the shipping destination that will be displayed at checkout before completing your purchase. All published online prices, payments, receipts and invoices are in €.

PAYMENT METHODS ACCEPTED
On www.shoesofitaly.com we accept all the most popular payment methods and guarantee total transaction security:

  • Credit cards via Stripe: Visa, MasterCard, American Express, Discover e Diners Club, China UnionPay, Japan Credit Bureau (JCB), eftpos, Cartes Bancaires.
    The credit card payment amount is debited from your card at the time of shipment.
  • PayPal and PayPal Express. The amount will be debited from your account at the time of shipment
  • Wire transfer

Cash on delivery is currently not allowed.

If there are enough funds, if the account information is valid and if there is confirmation from the payment provider that the transaction has been authorized, the order will be processed immediately and the Customer will immediately receive the transaction number of the order from our bank. 

The price for the purchase of products including any shipping costs, as indicated in the order form, will be charged to your account at the time of shipment of the purchased products.

SHIPMENT AND DELIVERIES

At the discretion of the Seller the products will be delivered through couriers of GLS or UPS.
Shipping times and costs depend on the shipping method chosen and do not include the time taken to prepare the order. At checkout you can choose between:

  • Standard delivery for Italy, within 4-5 working days: €9.00
  • Express delivery for Italy, within 2-3 working days: € 15.00

Deliveries take place at office hours from Monday to Friday, excluding public holidays. Using the tracking number that you will be sent at the time of dispatch, you can check the expected delivery date and any updates on the status of your shipment.
Please note: for shipments to Southern Italy and islands, delivery may take one extra working day. These delivery times do not apply for custom-made products, which take 4-8 weeks.

In case of shipment abroad through UPS, only for some countries (most of them are EU countries) it’s available the UPS Standard service. For all countries of destination it’s available the UPS Express Saver service (click here for the detailed shipping costs).

The possibility to return goods is always allowed (following all the terms specified in this document) but in case of return of goods from a country without UPS Standard service the shipment costs are covered by the Consumer.

How can I track my shipment?

When you place your order you will receive a shipment confirmation email with a link for you to track the delivery status.

What happens if the courier doesn’t find me at home?

In accordance with GLS and UPS procedures, if you are absent on the delivery attempt, the package will be delivered to the closest UPS Access Point (in case of shipment through UPS) of the
delivery address or to the closest authorized storage points. The package will remain in storage for a maximum of 7-10 days pending collection. At the end of the storage period, the parcel will be returned to the sender. Then, once the parcel is arrived back to the sender, a new shipment of the same parcel from the Seller will be charged to the customer recipient.

Please note that any additional costs (customs duties, import taxes and courier brokerage and disbursement fees) to import items purchased on the website www.shoesofitaly.com into non-EU countries are at Consumer’s expense as recipient of the goods.


RIGHT OF WITHDRAWAL

You have the right to withdraw from the contract with the Seller, without any penalty and without giving any reason, within fourteen (14) days from the day of receipt of the goods purchased on www.shoesofitaly.com.

The possibility to return goods is always allowed (following all the terms specified in this document) but in case of return of goods from a country without UPS Standard service the shipment costs are covered by the Consumer.

How can I make a return?

Without any penalty and without giving any reason, if you wish you can make a return within 14 days from the goods’ receipt, with a very simple procedure:

  • 1. Contact us writing to info@shoesofitaly.com and request the return procedure of the product specifying the product’s info and order number.
  • 2. Make sure the products are in the same condition as you received them, place them in their original box and carefully wrap the external packaging. 
  • 3. Print the prepaid label attached to the email you received at the end of the return procedure and stick it on the box. Take care to completely cover the previous label.
  • 4.Leave the parcel at the collection point indicated during the procedure.

When the product arrives at the warehouse and is checked by our operators, the amount of the product’s price will be credited back to the payment method you used to make the purchase.

Returned items must meet the following conditions in order for a refund to be made: all items must be returned in their original condition, with undamaged tags attached. Worn, used, altered or damaged merchandise will NOT be accepted. Shoe soles must be intact and undamaged, no scratches, so please try the product on a soft, clean surface.

Returned item(s) must be shipped inside the original box and sealed using the self-adhesive strip on the lid. They must be properly packaged, in the same way as they were received. Only if the original box is unusable another suitable box may be used to ship the item(s).

Item(s) must be returned with all original labels and identification tags still attached, including all original packaging and other accessories (dust bags, spare top-pieces, shoehorns, etc..) received with the ordered item(s). The Security Tag must still be intact and attached to the returned item(s). Item(s) returned without an intact Security Tag will not be accepted and will be shipped back to the customer at their expense.

Shoes and other accessories must be returned in a perfect condition with their original box, which must not be damaged and/or altered or used as the external packaging for the shipment. The original box of the products is to be considered itself as integral part of the product. Soles of footwear must be in a perfect condition and must not be marked in any way.

The Seller reserves the right to refuse applications for returns/exchanges that do not comply with all TERMS & CONDITIONS.

In case of non-compliant returns, the merchandise will be returned to the customer at the shipping address specified in the original order, at the customer’s expense.

It’s only allowed to return one single item for each order.

You must send the items back within 14 days from when you made the online return request.

Shipments of items returned to the Seller must originate from the same country of the original shipment.

If not allowed in advance by the Seller, it’s not possible to exchange the product with another one available on www.shoesofitaly.com, but the only possibility is to return it in the way as explained, receive the refund (if accepted) by the Seller and proceed with a new order of purchase by the Consumer.

In case of custom-made items they are considered final and therefore cannot be returned.

Please note that the Seller constantly monitors the number of returns. Frequent returns that do not comply with all TERMS & CONDITIONS will be flagged. The Seller reserves the right to close an account or not to complete orders of customers who continuously breach the TERMS & CONDITIONS.

In the event that a customer believes they has received defective or incorrect merchandise, the customer is required to immediately contact info@shoesofitaly.com. The Seller reserves the right to request photographic evidence before authorizing the return shipment of merchandise. If authorized, shipping costs will be covered by the Seller.

Can I return with a courier other than GLS and UPS?

You can return a product with a courier other than GLS and UPS, but in this case the shipping costs will be entirely on your charge, as well as the tracking of the shipment. 
Furthermore, the package will not be covered by our insurance in case of theft or loss. Finally, it will not be possible for us to intervene if any inconveniences arise during transit.

What are the refund times and methods?

Refunds are made after having verified the integrity of the returned items once they have arrived in the warehouse. This verification may take approximately 3 to 4 working days after delivery we received.
Following the verification and acceptance of the return, we will issue the refund as soon as possible within 14 days, directly to the payment method used for the purchase, and in the same currency.

PRODUCT CARE

Made using selected leathers and fabrics, shoes in the selection inside www.shoesofitaly.com offer the perfect mix of elegance and craftsmanship of Made in Italy production. Leather footwear must be regularly cared in order to fully appreciate their beauty and comfort for years to come, and any imperfections, creases, shading or irregularities are to be considered intrinsic characteristics of the product. We recommend storing the product in perfect condition, dry and clean, in a ventilated environment, away from heat sources and direct light from lamps or the sun, inside the bags provided in the packaging. It is recommended to not put shoes in direct contact with other leathers or fabrics and to avoid contact with alcohol, oils or solvents, and to ensure that ornaments and embroideries are well protected. It is recommended that you change shoes after every two consecutive days of use, which will allow the leather fibers to breathe and take a rest from stresses. Besides to prolong leather’s elasticity and maintain the shape of your footwear, it is advisable to fill the inside with soft tissue paper when not worn.

APPLICABLE LAW AND SETTLEMENT OF DISPUTES

The General Conditions of Sale are governed by Italian law and in particular by the civil code and by the legislative decree 6 September 2005 n. 206, consumer code, with specific reference to the legislation on distance contracts and the legislative decree 9 April 2003 n. on some aspects of electronic commerce.

MODIFICATION AND UPDATE

The General Conditions of Sale may be modified from time to time also in consideration of any regulatory changes. The new Conditions of Sale will be effective from the date of publication on www.shoesofitaly.com.
